Electronic Communications Consent Disclosure
Effective Date: July 01, 2023
By choosing to use the Mobile App or the Services, you will receive from time-to-time disclosures, notices, documents, and any other communications about our Services, the Mobile App, or Credit Convey from Credit Convey (“Communications”). We can only give you the benefits of our Services by conducting business through the Internet, and therefore we need you to consent to receive Communications electronically. This section informs you of your rights when receiving electronic Communications from us. We may discontinue the electronic provision of Communications at any time in our sole discretion.
By accepting these terms of use, you expressly give permission to Credit Convey to contact you according to the following terms:
1. CONSENTING TO ELECTRONIC COMMUNICATIONS FROM CREDIT CONVEY
1.1 Registration & Accounts
You agree that Credit Convey may contact you about any matter relating to your registration with Credit Convey, your submission of an inquiry for any Credit Convey product or service, your application for a product or service, and for any purpose arising out of or in connection with any account you may obtain from Credit Convey. We may contact you for any purpose related to any account you have, such as payment reminders or suspicious activity.
1.2 Marketing
You agree that Credit Convey may contact you to tell you about, and to offer for sale, products or services we believe will be of interest to you. If we do so, each communication we send to you will contain instructions permitting you to "opt-out" of receiving future communications.
1.3 Agents
You agree that Credit Convey may use agents or representatives to contact you on our behalf.
1.4 Phone, SMS, Auto dialers
You agree that Credit Convey may contact you through any means, including emails, telephone, SMS messages (including text messages), calls using prerecorded messages or artificial voice, and calls and messages delivered using automatic telephone dialing systems (auto-dialer) or an automatic texting system. Automated messages may be played when the telephone is answered, whether by you or someone else. Credit Convey and its agent or representative may leave messages on your answering machine, voice mail, or send messages via text.
1.5 Recorded Lines
You agree that Credit Convey and our agents, representatives, affiliates or anyone calling or contacting you on our behalf may contact you on a recorded line or recorded messaging service.
1.6 Accurate Numbers
You certify telephone numbers that you have provided to us are your contact numbers, and that you are permitted to receive calls at each of the telephone numbers you have provided to us. You agree to promptly alert us whenever you stop using a particular telephone number. We may contact you using any information you have provided to Credit Convey or any of its affiliates, at any telephone number, or any physical, email, or electronic address you provide or at which you may be reached.
1.7 Push Notifications / Alerts
You may select Credit Convey to send you messages called "Alerts" by text or phone. Alerts may be delayed or prevented by factor(s) affecting your internet/phone provider or other relevant entities. Credit Convey is not liable for losses or damages arising from non-delivery, delayed delivery, or the erroneous delivery of any Alert, or inaccurate Alert content. You are responsible for your use or reliance on the contents of any Alert for any purpose. The information in any Alert may be subject to certain delays. Each Alert may not be encrypted and may include your name and information pertaining to your account(s). Credit Convey may terminate your use of Alerts at any time without notice. You may choose to discontinue receiving Alerts by updating your Credit Convey App Notifications preferences.
1.8 SMS Notifications
All SMS Notifications in electronic format from us to you will be considered to be in writing.
1.9 Capability to View Messages
In order to access, view, and retain SMS Notifications that we make available to you, you must have: (i) a SMS-capable mobile phone, (ii) an active mobile phone account with a communication service provider; and (iii) sufficient storage capacity on your mobile phone.
1.10 You Are Responsible for Messaging Costs
Credit Convey MAY USE ANY MEANS OF COMMUNICATION DESCRIBED IN THIS SECTION EVEN IF YOU WILL INCUR COSTS TO RECEIVE SUCH PHONE MESSAGES, TEXT MESSAGES, E-MAILS OR OTHER MEANS. You are responsible for any and all charges, including but not limited to, fees associated with text messaging, imposed by your communications service provider. Please consult your mobile service carrier's pricing plan to determine the charges for sending and receiving text messages. These charges will appear on your phone bill. Message frequency depends on account status or settings. We may modify or terminate our text messaging services from time to time, for any reason, and without notice, including the right to terminate text messaging with or without notice, without liability to you.
2. CREDIT CONVEY SMS TWO-FACTOR AUTHENTICATION PROGRAM
1. This program is for the sending of two-factor authentication short code messages.
2. You can cancel the SMS service at any time. Just text "STOP" to the toll-free phone number. After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.
3. Carriers are not liable for delayed or undelivered messages.
4. As always, message and data rates may apply for any messages sent to you from us and to us from you. You will receive one message per authentication attempt. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.

3. COMMUNICATIONS IN WRITING
By accepting this Agreement, you agree that electronic Communications shall be considered "in writing" and have the same meaning and effect as if provided in paper form, unless you have withdrawn your consent to receive Communications electronically as stated below. You agree that we have no obligation to provide you with Communications in paper format, although we reserve the right to do so at any time.
4. WITHDRAWING CONSENT
You may withdraw your consent to receive Communications electronically by contacting us at support@creditconvey.zendesk.com. If you withdraw your consent, we will close your Mobile App user account and, if applicable, end your Personal Financial Management Services subscription. The legal validity and enforceability of prior Communications delivered in electronic form will not be affected by your withdrawal of consent. You also agree to pay any amount owed to Credit Convey such as any outstanding Bank Connection Fees even if you withdraw your consent and we close or limit access to the Mobile App and/or the Services.
5. UPDATING YOUR INFORMATION
As noted above, you can update your User Information in the Mobile App or by emailing us at support@creditconvey.zendesk.com.
